Welcome to Awakening of Her. These Terms of Use (“Terms”) form a binding agreement between you and Awakening of Her Sanctuary LLC (“Awakening of Her,” “we,” “us,” or “our”). They govern your access to and use of our mobile application, website, content, subscriptions, and related services (collectively, the “Service”).
By accessing the Service, creating an account, beginning a free trial, or purchasing a subscription, you confirm that you have read, understood, and agreed to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not access or use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.
2. The Service
Awakening of Her is a self-mastery and wellness application offering guided practices and content involving meditation, journaling, affirmations, knowledge, vision planning, movement, mood reflection, routines, habits, and related personal-growth tools.
We may add, remove, update, suspend, or modify features and content. We do not guarantee that any particular practice, feature, instructor, theme, or item of content will always remain available.
3. Wellness and Medical Disclaimer
The Service is provided for general educational, wellness, and personal-development purposes only. It is not medical care, mental-health treatment, psychotherapy, diagnosis, crisis support, or a substitute for advice from a qualified healthcare professional.
The Service does not promise or guarantee any particular health, emotional, financial, relationship, or personal-development result. Individual experiences vary. You are responsible for deciding whether a practice is appropriate for you.
If you have a medical or mental-health condition, are pregnant, are recovering from an injury, or have concerns about meditation, movement, or any other practice, consult a qualified professional before participating. Stop any movement or practice that causes pain, dizziness, distress, or discomfort. If you believe you are experiencing an emergency or may harm yourself or another person, contact local emergency services or an appropriate crisis service immediately.
4. Accounts and Account Security
You agree to provide accurate information, maintain the confidentiality of your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity occurring through your account to the extent permitted by law.
You may not impersonate another person, create an account using information you are not authorized to use, or transfer your account to another person.
5. Free Trial and Auto-Renewing Subscriptions
Beta Period: During the beta testing phase, the Service is provided free of charge, and subscriptions and free trials are not available. The subscription and trial terms described in this section will apply only once paid subscriptions become available through the Service. We will provide notice and obtain any consent required by applicable law and Apple policy before enabling paid subscriptions.
When subscriptions become available, eligible users may receive a seven-day free trial. Trial eligibility is determined by Apple and may be limited to one introductory offer per Apple subscription group. The available plan, billing period, renewal price, currency, and trial terms will be displayed before you confirm the subscription.
Awakening of Her does not collect or store your payment-card details. Purchases made in the iOS app are processed by Apple through your Apple Account. Apple may require a valid payment method when you begin the trial, but no subscription charge is made during the free-trial period.
Unless you cancel at least 24 hours before the trial ends, the subscription automatically converts to a paid subscription at the price and billing frequency shown when you subscribed. It then renews automatically until canceled. To avoid a renewal charge, cancel at least 24 hours before the end of the current subscription period. Apple charges your Apple Account according to its applicable subscription terms.
You can manage or cancel your subscription through your Apple Account subscription settings. Deleting the App or deleting your Awakening of Her account does not automatically cancel an Apple subscription. Cancellation takes effect at the end of the then-current billing period unless Apple states otherwise. Refunds, billing disputes, price changes, and payment processing are governed by Apple's applicable terms and policies.
If you begin a trial without confirming an Apple auto-renewable subscription, it cannot automatically become a paid subscription; you must separately authorize the purchase before any charge or automatic renewal can begin.
6. Inner Wealth
"Inner Wealth" is a symbolic, in-app motivational measure intended to reflect engagement with personal-growth practices. Inner Wealth is not money, legal tender, stored value, cryptocurrency, a security, compensation, or a financial product. It has no cash value and cannot be sold, transferred, withdrawn, exchanged, or redeemed for money, goods, or services.
You do not acquire a property interest in Inner Wealth. We may correct, adjust, reverse, or reset Inner Wealth amounts when reasonably necessary to address errors, duplicate awards, misuse, technical problems, or changes to the Service. Inner Wealth must not be represented as actual earnings or financial value.
7. Your Content
The Service may allow you to create or upload journal entries, images, vision-board materials, responses, routines, habits, goals, and other content ("User Content"). As between you and Awakening of Her, you retain ownership of your User Content.
You grant us a limited, nonexclusive license to host, store, process, reproduce, and display your User Content only as reasonably necessary to operate, secure, maintain, and improve the Service, comply with your instructions, and meet legal obligations. This license ends when the content is deleted from our active systems, subject to reasonable backup retention and legal requirements described in our Privacy Policy.
You represent that you have the necessary rights to upload your User Content and that it does not violate the law or another person's rights. Do not upload unlawful content, malicious code, or content that infringes privacy, publicity, copyright, trademark, or other rights. Keep independent copies of content that is irreplaceable to you.
8. Privacy
Our Privacy Policy explains how we collect, use, store, and disclose information. The Privacy Policy is incorporated into these Terms by reference. Because journals, mood reflections, vision-board materials, and similar entries may be personal, you should carefully protect access to your account and device.
9. Notifications and Communications
With your permission, we may send ritual reminders, account notices, and other notifications. Notifications are optional and are not required to use the core Service. You can change notification permissions through the App and your device settings.
We will not use push notifications for promotional or direct-marketing purposes unless you have provided the consent required by applicable law and Apple policy. Avoid placing information in the Service that you would not want reflected in a notification preview on your device.
10. Acceptable Use
You may not:
use the Service for unlawful, fraudulent, abusive, or harmful purposes;
interfere with, disrupt, probe, overload, or attempt to bypass the Service's security;
access another person's account or data without authorization;
copy, scrape, redistribute, sell, sublicense, or commercially exploit the Service or its content except as expressly permitted;
reverse engineer or attempt to derive source code except where applicable law prohibits that restriction;
use automated systems to extract content or data without written permission; or
misuse third-party content, links, audio, video, or services made available through the Service.
11. Awakening of Her Content and Intellectual Property
The Service and its branding, designs, text, prompts, rituals, audio, video, graphics, software, organization, and other content provided by us are owned by Awakening of Her or our licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for your own noncommercial purposes.
No rights are granted except those expressly stated in these Terms. "Awakening of Her," "Inner Wealth," and associated names, logos, and designs may not be used without prior written permission.
12. Third-Party Services and Content
The Service may link to or integrate with services provided by Apple, Google, Firebase, YouTube, Spotify, Notion, or other third parties. Their services are governed by their own terms and privacy policies. We do not control and are not responsible for third-party availability, content, security, practices, or transactions. You must comply with applicable third-party terms when using the Service.
13. Account Deletion and Termination
You may request account deletion using the in-app deletion feature or by contacting us. Account deletion is handled as described in our Privacy Policy and does not automatically cancel an Apple subscription.
We may suspend or terminate access if you materially violate these Terms, create risk or harm, misuse the Service, or if suspension is reasonably necessary to comply with law or protect the Service and its users. Where appropriate, we may provide notice and an opportunity to address the issue.
Sections that by their nature should survive termination, including ownership, disclaimers, liability limitations, and dispute provisions, will survive.
14. Service Availability
We work to provide a reliable Service but do not guarantee uninterrupted, error-free, or permanently available access. Maintenance, technical failures, internet or third-party outages, security events, and circumstances beyond our control may affect availability. Features may behave differently across devices, operating systems, and regions.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." AWAKENING OF HER DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
We do not warrant that the Service will always be available, secure, accurate, complete, or free of harmful components, or that using it will produce a specific outcome. Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWAKENING OF HER AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited, including certain liability for fraud, intentional misconduct, or personal injury. Your mandatory consumer rights remain unaffected.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Awakening of Her and its members, employees, contractors, and service providers from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the Service, your User Content, or your material violation of these Terms or another person's rights.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Subject to any mandatory consumer protections that apply to you, disputes relating to these Terms or the Service will be brought in the state or federal courts serving Brown County, Wisconsin, and you consent to their jurisdiction.
If you live in a jurisdiction that gives you mandatory rights to bring claims in your place of residence or under local law, this section does not take those rights away.
Before filing a claim, you and Awakening of Her agree to make a good-faith attempt to resolve the dispute informally by emailing hello@awakeningofher.com with a description of the issue and requested resolution.
19. Apple App Store Terms
The iOS App is licensed, not sold. Apple's Standard Licensed Application End User License Agreement applies to your use of the iOS App in addition to these Terms. If these Terms conflict with Apple's Standard EULA regarding the license to the iOS App, Apple's Standard EULA controls.
These Terms are between you and Awakening of Her, not Apple. Awakening of Her, not Apple, is responsible for the Service, its content, maintenance and support, and claims relating to it, except as otherwise provided by law or Apple's terms. Apple has no obligation to provide maintenance or support for the Service.
Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the iOS App and may enforce the applicable provisions against you. You represent that you are not located in a country or region subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on a U.S. Government prohibited or restricted-party list.
20. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, or our practices. We will post the updated version and revise the effective date. When required, we will provide additional notice or obtain consent. Continued use after an update becomes effective constitutes acceptance to the extent permitted by law.
21. General Terms
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, reorganization, sale of assets, or by operation of law. These Terms, the Privacy Policy, Apple's applicable EULA, and any purchase terms shown at checkout form the agreement governing your use of the Service.
